APPROVED MINUTES
Public hearing on Monday, May 6, 2019, in the Council Chambers at City Hall for public comments on abandonment of a portion of Larch Street located between Highway 2 and Millwood Loop.
Call to Order:
The meeting was called to order at 6:30 pm by Mayor Brent Teske.
Present were Ms. Williams, Mr. Zimmerman, Mr. Beach, Mr. Taylor, Mr. Dufficy, Deputy City Clerk Jody Martin, City Administrator Jim Hammons and City Attorney Dean Chisholm.
Mayor Teske said a recommendation was made by street committee to abandon this section of Larch
Street. In order to make it legal and binding council needs to pass a resolution and get it recorded.
Mayor Teske asked if anyone has unresolved issues or questions, before opening to public.
Public Comment:
DC Orr – 1117 Nevada Avenue asked if there was a map of this somewhere.
Mayor Teske responded that a map that went to the attorney’s office when it was under review has
not been returned.
Orr said “The last time this was on the agenda, I was concerned that there was a plat to this, also you are withholding information from the public, no one can comment on this because no one has seen a map. Orr continued “We don’t even know how far Larch went into the Millwood subdivision or if Millwood loop is a city street or private drive. Are you blocking access to other properties by doing this?”
Teske said he could answer this, “No.”
Mr. Beach said there was property behind Big Sky Lumber that they have acquired and there is no property behind it. There is another little shop back there, and there is a recorded easement.
Mayor Teske said that was part of discussion from Mr. Brooks to his attorney to make sure this was done properly back in 2005.
Orr said” It was allowed to be done improperly in 2005, there should be a penalty for that. It has a lot to do with transparency, you have a transparency issue coming up in June.”
Mayor Teske told Orr, “You are always welcome to attend the streets committee meeting, that’s where this would be discussed.”
Mayor Teske asked if there were more public or Council comments.
